These Terms and Conditions ("Terms") govern your access to and use of all products and services provided by Mordor Intelligence Private Limited ("Mordor Intelligence," "we," "our," or "us") through its website www.mordorintelligence.com ("Website"), including without limitation, industry research reports, digital products, and the subscription-based Data Center Intelligence platform.

By accessing or using our website or purchasing our products, you agree to be bound by these Terms. If you do not agree, you must not use our website or any of our services.

  • 1.

    Definitions

    For the purposes of these Terms:
    • "Client" or "You": means any person or entity purchasing, accessing, or using Mordor Intelligence products or services.
    • "Data Center Intelligence": means the subscription-based digital intelligence platform hosted on the Mordor Intelligence Website that provides data, analytics, and insights related to data centers, accessible through login credentials.
    • "Subscription Plan": refers to the tiered access options (including Annual and Premium plans) available to Clients for the Data Center Intelligence product.
    • "Content": refers to all information, data, analysis, reports, charts, dashboards, and other materials made available by Mordor Intelligence.
    • "Order": means any purchase made by the Client through the Website or via the Mordor Intelligence sales process.
  • 2.

    Scope of Agreement

    These Terms apply to:
    • a) All purchases of Mordor Intelligence products and services, including downloadable reports and datasets;
    • b) All subscriptions to the Data Center Intelligence platform; and
    • c) All interactions with the Mordor Intelligence Website, including accessing free and paid content.
  • 3.

    Access to Data Center Intelligence Platform

    • 3.1. Subscription Access: Clients who purchase a Data Center Intelligence subscription will receive unique login credentials to access the platform via a secure dashboard hosted on the Mordor Intelligence Website. Access is limited to the number of authorized users under the purchased plan.
    • 3.2. Tiered Subscription Plans: Different subscription tiers offer varying levels of access based on dataset coverage, analytics depth, and feature availability. Details of available plans are displayed on the Website or shared by our sales team.
    • 3.3. Subscription Term and Renewal: All subscriptions are annual unless expressly stated otherwise. Renewal reminders will be issued by Mordor Intelligence prior to the end of the subscription term. Renewal payments must be made before expiration to avoid disruption of access.
    • 3.4. Account Management: Mordor Intelligence’s sales and account management teams will support subscription setup, renewals, and access issues. Clients must ensure that authorized users maintain confidentiality of login credentials. Sharing login credentials outside the authorized organization is strictly prohibited.
    • 3.5. Suspension or Termination: Mordor Intelligence reserves the right to suspend or terminate access without refund in cases of:
      • Violation of these Terms;
      • Unauthorized sharing or misuse of credentials;
      • Payment default; or
      • Use of the platform in a manner detrimental to Mordor Intelligence’s interests.
  • 4.

    Orders, Pricing, and Payments

    • 4.1. Order Process: Orders may be placed via the Website or directly through Mordor Intelligence's sales representatives. All orders are subject to acceptance and confirmation.
    • 4.2. Payment Terms: Full payment must be made prior to the delivery of reports or activation of subscription access unless otherwise agreed in writing. All payments shall be made in the currency specified on the invoice.
    • 4.3. Taxes: Prices are exclusive of applicable taxes, which will be added as required by law. Clients are responsible for payment of all taxes, duties, or levies applicable to their purchase.
    • 4.4. Refund Policy: Due to the nature of the data and digital products sold, all sales are final. No cancellations, exchanges, or refunds are permitted once the product has been dispatched or subscription access granted.
  • 5.

    Delivery and Shipping

    • 5.1. Digital Delivery: All industry reports and related products are delivered electronically via email as PDF, Word, or Excel documents within 24 to 72 hours of purchase. Pre-booked or pre-release reports will be delivered on the scheduled release date.
    • 5.2. Delays and Force Majeure: Mordor Intelligence shall not be held responsible for any loss or damage arising directly or indirectly from delays or failure to deliver products due to causes beyond our reasonable control, including but not limited to natural disasters, war, strikes, civil unrest, or government restrictions. Delivery time will be extended accordingly, allowing reasonable time to fulfill your order.
    • 5.3. Electronic Product Integrity: Clients must ensure that their email systems and IT infrastructure are capable of receiving electronic files. Mordor Intelligence is not liable for delivery failures caused by Client-side technical issues.
  • 6.

    Intellectual Property and Use of Content

    • 6.1. Ownership: All content, reports, data, and materials provided by Mordor Intelligence, including those accessible on the Data Center Intelligence platform, are protected by copyright and other intellectual property laws. All rights are either owned by Mordor Intelligence Private Limited or licensed to it.
    • 6.2. Permitted Use: Clients are granted a limited, non-exclusive, non-transferable right to use the purchased content or platform for internal business purposes only.
    • 6.3. Prohibited Use: Without prior written consent from Mordor Intelligence, you may not:
      • Resell, distribute, copy, or reproduce content in any format;
      • Share login credentials or redistribute platform access to unauthorized users;
      • Use content to create derivative products or competitive services; or
      • Use the Website or platform in any unlawful or unauthorized manner.
    • 6.4. Breach and Enforcement: Any breach of this section may result in immediate termination of access, civil liability, and/or criminal prosecution.
  • 7.

    Website Use and Content Disclaimer

    • 7.1. Informational Nature of Content: The information provided on the Website is offered in good faith for general informational purposes. No warranties are made regarding its accuracy, completeness, or suitability for a particular purpose.
    • 7.2. Liability Limitation: Mordor Intelligence shall not be liable for any loss or damage, direct or indirect, arising from use or inability to use the Website or any content therein. This includes, but is not limited to, lost business opportunities, profits, or data.

      Nothing in these Terms limits liability for personal injury or death caused by negligence.

    • 7.3. User Communications: By submitting personal information through any form on the Website, you consent to being contacted by Mordor Intelligence representatives by phone or email.
  • 8.

    Data Protection and Privacy

    Your personal data will be collected, used, and processed in accordance with our Privacy Policy, available on our website. By using our services, you consent to such processing.
  • 9.

    Confidentiality

    All purchased reports and subscription data are provided under strict confidentiality. Clients agree not to disclose any non-public information obtained through Mordor Intelligence to third parties without written consent.
  • 10.

    Limitation of Liability

    To the fullest extent permitted by law, Mordor Intelligence, its affiliates, and licensors shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to:
    • Use of the Website or Data Center Intelligence platform;
    • Inaccuracies in data or content;
    • Loss of profits or business interruption; or
    • Unauthorized access to your account or information.
  • 11.

    Indemnification

    You agree to indemnify and hold harmless Mordor Intelligence, its directors, employees, and agents from any claim, loss, or damage arising out of your violation of these Terms or misuse of any Mordor Intelligence product or platform.
  • 12.

    Termination

    Mordor Intelligence reserves the right to terminate or suspend your access to its website or services without notice if you breach these Terms or engage in misuse of the content.
  • 13.

    Governing Law and Jurisdiction

    These Terms are governed by and construed in accordance with the laws of India. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in Hyderabad, Telangana, India.

    Amendments

    Mordor Intelligence may revise these Terms at any time without prior notice. The most current version will always be available on our website. Continued use of the Website or services constitutes acceptance of any modified Terms.
